COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Jaunary 23, 2015 <br />Fred Marvel <br />Brannan Sand & Gravel Company <br />2500 East Brannan way <br />Denver, CO 80229 <br />Re: Pit 29, DRMS Permit No. M- 1980 -183, <br />Reclamation Permit Amendment Application No. 2 (AM -02), <br />Preliminary Adequacy Review <br />Dear Mr. Marvel: <br />The Division of Reclamation, Mining, and Safety (Division) has completed its preliminary adequacy <br />review of your 112 construction materials reclamation permit amendment No. 2 (AM -02). AM -02 was <br />called complete for review on January 9, 2015. Please be advised that if you are unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your responsibility to <br />request an extension of the review period. If there are outstanding issues that have not been adequately <br />addressed prior to the end of the review period, and no extension has been requested, the Division will <br />deny AM -02. Please submit adequate responses to the comments contained in this letter as soon as <br />possible in order to resolve item number 3 of the Order issued by the Mined Land Reclamation Board on <br />November 13, 2014 regarding the Permanent Groundwater Mitigation Plan. <br />This review consisted of comparing the application with specific requirements of the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Board for the Extraction of Construction <br />Materials (Rules). In general, the application was adequate; however, as with most applications there <br />are a few items that will require the submittal of additional information or clarification of the existing <br />information. Inadequacies are identified under the respective exhibits, along with suggested actions to <br />correct them. <br />APPLICATION FORM: <br />1) Please re- submit all portions of the amendment application where the Operator provided the <br />company name, the amendment application will need to be filed with the company name spelled <br />exactly the same as the entity is registered with the Secretary of State. For example on page, 8 of <br />the application the Applicant/Operator submitted the application with the "Applicant/Operator or <br />Company Name" as "Brannan Sand & Gravel Co ". However, after checking the registration with <br />the Secretary of State the entity's name is registered as `BRANNAN SAND AND GRAVEL <br />COMPANY, L.L.C.
