In the letter dated November 3, 2014, the Division requested that the Applicant contact the <br />Colorado Department of Public Health and Environment (CDPHE) to obtain a discharge <br />permit. The Applicant responded that CDPHE did not require a discharge permit for a <br />prospecting project of similar scope. Typically, when there is a point source, the Division <br />wants to ensure the Applicant has inquired about the need to get a discharge permit. The <br />Division cannot review sampling data to absolve or waive that requirement. For our <br />purposes, an Applicant may either demonstrate (to CDPHE) they don't need a discharge <br />permit and get a letter to that effect from CDPHE, or they may demonstrate (to DRMS) that <br />they have a discharge permit and can comply with the requirements of that permit during the <br />course of their proposed activities. <br />Be advised that if these items have not been addressed by the current decision date, the Division <br />may terminate the NOI application in accordance with Rule 5.1.3(c) of the Hard Rock Rules. <br />Please remember to designate as appropriate those materials in the application that you desire to <br />be made confidential versus those to be made public. <br />If you have any questions, you may contact me at (303)866 -3567 x8116. <br />Sincerely, <br />/9 L <br />Michael A.
