Box 19 <br />Alma, CO 80420 <br />RE: Notice of Intent to Conduct Prospecting Application; Hock Hocking Mine; File No. <br />P- 2014 -019; Second Notice of Deficiencies <br />Dear Mr. Misantoni, <br />The Division has identified several other comments and questions that must be addressed prior to <br />the Division's decision due date. Please be advised that if you are unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. If there are outstanding issues <br />that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division may deny this application. <br />1. The Applicant has stated that water at the portal will be sampled during the half way through <br />the project. Please specify if additional sampling will be conducted prior to or after the <br />drilling program is complete or otherwise explain how collecting samples before the project <br />is over will demonstrate that the quality of the water has not been impacted by drilling. The <br />Division believes additional sampling events will be necessary to demonstrate the <br />prospecting project did not have a negative impact on water quality. Water samples should be <br />collected prior to, during, and after the drilling program. <br />2. The Applicant has committed to sampling the water discharging from the Hock Hocking <br />portal. However, the Applicant has not explained how the proposed sampling program will <br />ensure the prospecting operation is in compliance with applicable water quality laws and <br />regulations. Water quality data from 1993, 1997, 2006 and 2014 have been submitted. <br />However, at no point has the standard five quarters of sampling been conducted to establish a <br />baseline for the quality of the water discharging from the mine. In addition, it does not appear <br />the same locations have been sampled during each sampling event. The Applicant has stated <br />the water discharging from the Hock Hocking mine will be sampled approximately half way <br />through the project.
