2.05.3 <br />per every other layer, at random locations across the ponds. <br />The area will be restored to approximate original contour. Topsoil will be <br />replaced in the small portion of pond #2 where it was salvaged. In accordance <br />with Rule 4.17, the Operator will stabilize the industrial area to effectively control <br />erosion and attendant air pollution by placing the salvaged ballast and sub - ballast <br />on the 40 acre industrial area. Alternative sediment control will be used for the <br />reclaimed areas east and west of Reed Wash. See section 2.05.4 for further <br />discussions regarding sedimentation control after reclamation. <br />(iii) None of the sediment ponds meet the size requirements of this section, therefore <br />this section is not applicable. <br />(iv) Not applicable, the sediment ponds do not meet the size criteria. <br />(v) Not applicable, plans do not need to be submitted to MSHA or the Office of the <br />State Engineer. <br />(vi) The three impoundments do not meet the class B or C criteria for dams. The <br />ponds are considered class A dams. Class A dams are dams located in rural or <br />agricultural areas where failure may damage farm buildings, agricultural land, or <br />township and country roads. <br />(vii) The impoundments do not meet the class B or C criteria for dams. <br />(b) The sediment ponds are considered temporary ponds and are designed to meet <br />the requirements of Rules 4.05.6 and 4.05.9. <br />(c) Not applicable. <br />(d) Collection ditches and diversion ditches have been designed to comply with the <br />requirements of rules 4.05.3 and 4.05.4. <br />Runoff from the eastern loadout disturbance is contained in sediment pond <br />number 1 which contains the run -off from the light use road, coal loading system, <br />coal stockpile, material storage area and truck dump. Run -off from the rail track <br />and rail loop east of Reed Wash is managed according to Rule 4.03.1(4)(a)(iv), <br />and best management practices will apply for the majority of the Loadout loop as <br />Permit Application 2.05 -21 01/12 <br />
