2.04.7 Hydrology Description <br />by the loadout operation because they are located west of Loma Drain. <br />In the event that contamination, diminution, or interruption in the <br />underground or surface water supplies result from coal mining operations, <br />the following protective measures would be followed. <br />1) Adequate protection of water rights will be monitored. The Applicant <br />has designed and implemented a complete hydrologic monitoring <br />program. <br />2) Alternative sources of water will be utilized, if required. The Applicant <br />has a 150 cfs conditional water right for industrial and domestic uses on <br />the Colorado River with a diversion point located southeast of the <br />proposed loadout as shown on Map 18, map code 28. This water right is <br />called the Mack Pumping and Pipeline This alternate source of water <br />supply could be developed to replace any water right harmed by the <br />proposed loadout operation. A copy of documents that confirm the water <br />right, Case No. 02CW92, are located Volume I, Tab 1. <br />3) The Applicant has conditional water rights for two surface diversion <br />points as shown on Map -18, map codes 33 and 34. The water rights are <br />called Tavistock #1 and Tavistock #2, respectively. Tavistock #1 claims <br />2.5 cfs conditional, and Tavistock #2 claims 0.75 cfs conditional. The <br />water rights give the Applicant the right to divert from both Loma Drain and <br />Reed Wash for industrial and other uses, as listed in the permit. Tavistock <br />retains a 50% interest in the water rights for its own uses, but the <br />Applicant is responsible for the water right.
