Box 535 <br />Somerset, CO 81434 <br />RE: Elk Creek Mine; Oxbow Mining, LLC.; C- 1981 -022 <br />2011 and 2013 Annual Reclamation Report Review Memo <br />Dear Mr. Kiger: <br />The Colorado Division of Reclamation, Mining, and Safety (CDRMS) has reviewed the 2011 and <br />2013Annual Reclamation Reports for the Elk Creek Mine to determine compliance with Rule 2.04.13. <br />The review is ordered in the sequence of each sub - paragraph of the Rule. Adequacy review items are <br />listed at the end of this document. <br />(1) The Division received the 2011 Annual Reclamation Report (ARR) for the site on February <br />3, 2012. The 2013 report was received on May 2, 2014. The 2013 annual reclamation <br />report was not received by the required February 15th deadline in accordance with Rule <br />2.04.13. <br />(a) The name and address of the permittee and permit number is reported on the 2011 and <br />2013 ARR form. <br />(b) Oxbow Mining, LLC. (Oxbow), provided a list of all the disturbed areas and their <br />associated acreages. According to the report, 9.82 acres were disturbed during 2011 at <br />the Elk Creek Mine associated with the construction of 15 gob vent borehole pads and <br />roads. These pads are depicted on Map 2.05 -M1 of the permit. For 2013, Oxbow <br />reported to have disturbed 4.00 acres associated with the construction of seven "mine <br />recovery boreholes ". These holes are depicted and labeled on Map 2.05 -M1 of the <br />permit. <br />(c) Oxbow indicated they backfilled and graded 14.08 -acres during 2011. According to the <br />cover letter of this report, this work was associated with the reclamation of gob vent <br />boreholes, roads and the Hubbard Fansite. The report includes a list of the names of the <br />disturbed areas, their acreages and their status (existing or reclaimed).
