CITIZENS ANIMAS IRRIGATION Co. <br /> DURANGO, COLORADO <br /> OPERATING PROCEDURE 83-1 <br /> Guidelines for use by the Board of Directors in <br /> evaluation of construction and development along and <br /> over the ditch right-of-way. <br /> I. Notification. <br /> A. Prior to any encroachment over the ditch right-of-way the <br /> Board of Directors shall be notified by the landowner direct- <br /> ly or through the LaPlata Planning Commission. Such notice <br /> shall provide 15 days for the Board to inspect the premises, <br /> evaluate the impact of the proposed project on the ditch, and <br /> furnish a written response registering approval or specifying <br /> deficiencies and recommending changes to correct such defic- <br /> iencies. <br /> B. Notification shall be reouired on any permanent type <br /> appurtenance including, but not limited to, fences, gates, <br /> bridges, culverts, roads and pipes. <br /> II. Standards. <br /> A. Fences. Fences crossing the ditch shall be constructed <br /> with an access gate not less than fourteen in width on the side <br /> } of the ditch used used for access and for machinery used in <br /> cleaning, such gate to be located above the slope of the bank <br /> to facilitate movement of machinery. In addition, a gate across <br /> the ditch itself shall be provided to allow mavement of mach- <br /> inery along the bottom of the ditch. This gate may be weighted <br /> if desired, however, it shall not reach near enough to the water <br /> line to catch floating trash. Both gates snail beconstructed <br /> so as to be easily opened. Fences and gates shall be reason- <br /> ably maintained by the landowner and the Company snail not be <br /> bald rcaponsib le for damage to livestock or crops resulting <br /> from broken or poorly maintained gates or fences. <br /> B. Crossings. Due to the flat grade of the ditch, it is <br /> necessary that any bridge or culvert shall not impede the flow <br /> of water. <br />
