The area affected by construction activities will be
approximately 100' by 2,100', or 4.8 acres.
Pursuant to a request from the Einspahrs, Brannan will be filling a portion of their
property as part of the consideration for the Einspahrs' authorization for installing
the south French drain. This filling activity is occurring outside of the permit
amendment and, once in place, will be considered the "existing" topography for
purposes of this permit amendment.
During excavation for the French drain, the topsoil will be stockpiled and used for
reclamation. Since the actual excavation is only 10' in width, the area will be
reclaimed with the existing slopes and drainage.
Reseeding will occur on both the excavated area and the area affected by the
construction of the French drain. Earthmoving will consist of backhoe trenching.
The trench will be backfilled with gravel from the present mining of Pit 29. The
gravel will extend to within 1 -2 feet of the surface. Native soil will be used to fill
to the surface.
The post- mining uses will not change from the previous amendment except that
the post- mining uses for the added Einspahr parcel will be the uses to which the
Einspahrs make of that parcel in their discretion.
The reclamation of the affected area will commence immediately upon
completion of drain installation and backfill unless such installation and backfill is
completed prior to the spring of 2015, then the reclamation will commence as
