PERMIT#:M-1991-080 <br /> INSPECTOR'S INITIALS:TC1 <br /> INSPECTION DATE:January 28,2014 <br /> ii) As the reclamation plan is assumed to have changed significantly, the Operator will need to review <br /> and revise the items in Rule 6.3.4(1) to be consistent with the intent and specifics related to the <br /> change in the post mine land use to "horse corral". <br /> 3) Technical Revision No. 1 (TR-01) and Succession of Operator (SO-01), both approved in 2005 have <br /> incomplete documentation. <br /> a) TR-01 —this revision requested a change in the post mine land use to "horse corral". The Division has <br /> no documentation on file to describe why the bond was reduced from $15,899 calculated (see <br /> enclosed estimate forms for your reference) as the Succession of Operator process began, to the <br /> current $5,089, presumably related to the approval of TR-01 (see enclosed approval letter). <br /> b) SO-01 — the Division requires a documented Source of legal right to enter to conduct mining and <br /> reclamation (Reference Rule 6.3.7) as part of an SO revision. The Division has no such documentation <br /> for the current Operator. This may be a copy of access lease, deed, abstract of title, current tax receipt, <br /> or a signed statement by the Landowner and acknowledged by a Notary Public stating that the <br /> Operator/Applicant has legal right to enter and mine is also acceptable. <br /> 4) The previous inspection was performed on 12/2/2009. No problems were cited. <br /> 5) The anniversary date is October 25. Annual reports and fees are current through 2013. A review of the <br /> Division's database suggests the 2013 annual report and fee was submitted late (April 16, 2014) and that <br /> the 2014 annual report and fee has not been submitted. The Operator will be notified under separate <br /> cover as to what is required for the late annual report. <br /> Current Stipulations: <br /> None. <br /> Bond: <br /> The current bond has not been updated since 2005. The specifics of the reclamation plan are unclear due to <br /> the lack of records the Division has on file. The Division will revisit the bond after the Operator submits and <br /> the Division approves a technical revision to update the reclamation plan as approved in TR-01. <br /> Summary and Recommendations: <br /> 1. The Division's files for this permit are incomplete. <br /> 2. Within 60 days of this report, the Operator must submit a Technical Revision (TR) to update the <br /> mining and reclamation plans, and the Mine Plan Map and Reclamation Plan Map as discussed in the <br /> records section of this report. The TR and the $216 required fee must be submitted to the Division <br /> within 60 days of the date of this report. A TR request form is enclosed for your convenience. <br /> 3.
