C- 1981 -028. I, Jared Ebert of the Colorado Division of Reclamation, Mining and Safety conducted the <br />inspection. Mr. Dan Hernandez and Tabetha Lynch with the Division accompanied me during the inspection. Mr. <br />Danny Kipp with CEC also accompanied us during the inspection. The weather was cold and windy. <br />AIR RESOURCE PROTECTION — Rule 4.17: <br />The weather was windy at the time of the inspection. The access road around the site was graded and maintained. <br />CEC has been placing a layer of spoil on top of the recently backfilled ash to limit wind - spread. <br />BACKFILL and GRADING — Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); <br />Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br />We walked through parcels 32, 31, and 30. CEC has requested Phase I bond release on these parcels with the SL7 <br />application. This application has not been deemed complete at this time. These parcels have been graded and the <br />topography blends into the surrounding area. An inspection will be conducted on a later date to confirm if the land <br />has been backfilled and graded to the approved post mine topography. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Dugout Pond and Sediment Pond No. 2 were observed. The ponds were dry and their side slopes were stable and <br />vegetated.
