Compliance With Mine Plan <br />N - Support Facilities Not On -site <br />N - Other <br />N - Special Categories Of Mining <br />N - Processing Waste <br />R - Topsoil <br />COMMENTS <br />This was a partial inspection of the New Horizon North Mine conducted by Brock Bowles of the Colorado <br />Division of Reclamation Mining and Safety. Frank Ferris of Western Fuels- Colorado (WFC) was present during <br />the entire inspection. The weather was overcast, cool with no wind. The ground conditions were dry. Coal was <br />not being hauled to the power plant at the time of this inspection. The abatement date for violation number CV- <br />2014 -004 has been extended to January 16, 2015. <br />AIR RESOURCE PROTECTION — Rule 4.17: <br />A water truck was watering the main haul road for dust suppression. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Pond 001 contained water but was not discharging. Water was being pumped into the water storage tank <br />and overflowing through a plastic pipe into Pond 001. <br />Pond 001- east segment 6 is a rubber lined ditch. The ditch has a significant amount of sediment that needs to be <br />removed (photo 1). <br />Pond 001- east segment 7 is not configured as outlined on Map 2.05.3(4) -7. At location 26 +75, the geo -web <br />under the rock is not in place high enough up the south and north side slopes for the required flow line (photo 2). <br />A second discontinuous piece of geo -web is higher on the south side bank (photo 3). Also, the typical cross <br />section of the ditch is drawn as 21.9' wide, but nowhere is this cross section seen in segment 7. The bottom of the <br />ditch is filled with 6 inches of soil and rock above the geo -web. <br />Pond 001 east ditch segments 1 and 2 are designed to be lined with geo -web as per Map 2.05.3(4) -7.
