PAGE 2 DECEMBER 24, 2014 I have decided that using a single special seed to just seed the commercial/industrial areas of site is impartial and causing too many distractions for completing this adequacy review. If, the need arises to seed the proposed commercial/industrial areas before development begins, then Frei will seed the area with the approved seed mix. Attached is a revised page 16 reflecting the wording as requested. General Comments and Questions 29) Please address and respond to the following 5 questions asked in the attached Memo from DRMS's staff. The attached memo addressed the review of slope stability provided by Deere and Adult. Attached are our responses to Mr. Hays' slope stability questions. 31) Please review the attached financial warranty calculation. DRMS calculated the financial warranty for the worst-case scenario. DRMS estimated the financial warranty for a scenario were no inert fill is placed in Phase 2. In this case, DRMS would need to backfill all slopes to 3H1:1V, spread topsoil, and seed the entire site with the option 1 seed mix. After careful review of the proposed Financial Warranty calculations we find them acceptable. I only request that the final bond amount be rounded to the closest $100's or $809,500.00 for book keeping purposes. Attached is a revised copy of Map Exhibit C-1 - Mining Plan Map showing the revised setback along the north side of Stage 1 and the corrected cross-sections. I also revised page 7 to fix the Stage 2 Side sloping and included a redline copy of the page so you can see the change I made. I will place a copy of this packet in the Adams County Clerks file copy and once I have it will provide proof of placement.
