Structure Agreement <br /> Engineering Evaluation <br /> Prepared for Nevadaville Encore, LLC and Xcel Energy by Albert J. Barnhard, Consulting <br /> Mining Engineer. <br /> This letter has been provided to Xcel Energy as the owner of a structure within 200 feet of a <br /> proposed mine site. The State of Colorado, Division of Reclamation Mining and Safety requires <br /> that where a mining operation could adversely affect the stability of any significant , valuable <br /> and permanent man-made structure located within two hundred (200) feet of the affected land for <br /> proposed mining, the Applicant shall either: <br /> Provide a notarized letter from Nevadaville Encore stating that the Applicant will provide <br /> compensation to Xcel Energy for any damage to the structure caused by the Applicant's <br /> proposed mining; or <br /> Where such structure is a utility, the Applicant may supply to the Division a notarized letter, on <br /> Xcel Energy letterhead, stating that the proposed mining and reclamation activities as described <br /> in the permit application will have "no negative affect" on their utility property near the <br /> proposed mine site. (ref.: Construction Materials Rule 6.3.12 and Rule 6.4.19& Hard <br /> Rock/Metal Mining Rule 6.3.12 and Rule 6.4.20) <br /> The mining project is proposed for the Iron& Wm. Richardson Lode Claims in Gilpin County, <br /> Colorado, 0.4 miles east off Co. Rd. 279 on Druid Mine Road. Nevadaville Encore, LLC, P. O. <br /> Box 1442, Central City, CO 80427, (303) 681-1111, has applied for a Limited Impact (110d) <br /> Operation Reclamation Permit Application No. M-2014-066 with the Colorado Division of <br /> Reclamation, Mining and Safety. <br /> This proposed project lies within Township 3 South, Range 73 West, in the NE 1/41/4 of the NW 1/4 <br /> of Section 23. The areas of anticipated disturbance are within the easternmost 500 feet of the <br /> Richardson Lode Claim, U. S. M. S. No. 233, and 185 feet near the center of the Iron Lode <br /> Claim, U. S. M. S. No. 572. <br /> Permanent man-made structures include Druid Mine Road, which crossed the Richardson claim <br /> and lies just north of the north sideline of the Iron claim. Druid Mine Road is an unmaintained <br /> Gilpin County Road and is not privately owned. <br /> A three-phase power line, owned and erected by Xcel Energy, runs northerly about 100 feet to <br /> the east of the Richardson claim's east endline. No part of this proposed operation will <br /> negatively impact Druid Mine Road or this power line.
