1. Section 2.04.6, page 1 of the permit references Coal Mining Permit C -81 -008 for baseline surface <br />and groundwater quality data. It is suggested that this information be incorporated into permit C- <br />2010 -089, as permit C- 1981 -008 may be terminated prior to permit C- 2010 -089 being terminated <br />2.04.7(2) — Baseline Hydrology Description <br />The last sentence of Rule 2.04.7(2)(a) states that the permit application shall contain information <br />pertaining to ownership and use of surface water bodies. Map 2.04.3 -1 depicts the location of <br />surface water bodies in and adjacent to the permit area. There is also a discussion of stock water <br />ponds, on page 21 of Section 2.04.7, that is limited to a discussion of how they will be affected <br />with the diversion of the 2nd Park Lateral, but no description of the ownership of the stock ponds. <br />It does not appear that the approved permit application has provided sufficient information <br />pertaining to ownership and use of surface water bodies. Please either revise the permit <br />application to include a description of the ownership and use of surface water bodies, or indicate <br />where the information is located in the currently approved permit application package. <br />2.04.9 — Soils Resource Information <br />In the opening paragraph, it states that Permit C- 1981 -008 was approved in May of 1993. The <br />Division's records indicate that it was approved in 1983. Please correct this typo in the text. <br />On page 27 second paragraph, it states that the Regional Supplement to the Corps of Engineers <br />Wetlands Delineation Manual: Arid West Region was issued in 2205. Please clarify the date of <br />issue for this supplement and correct the text. <br />2.04.11 — Baseline Fish and Wildlife Information <br />Page 4 states that WFC commits to consult with the appropriate Federal and State wildlife <br />officials and modify the scope and focus of the fish and wildlife protection measures and the <br />wildlife mitigation monitoring requirements contained in Section 2.05.6. Per Rules 2.04.11(4) <br />and 2.05.6(2), please update T &E species and discuss potential impacts to current State and <br />Federal Threatened and Endangered plant and animal species lists. The Federal and State listed <br />species of concern may have changed since the last revision or the issuance of the permit. <br />2.05.2 — Operation Plan / Life of Mine <br />The Division understands that the initial phases of mining at NH North differed somewhat from <br />what was described in the initial permit. Specifically, a buffer of unmined coal resource (and <br />overburden) was left in -place at the location of the old Peabody highwall. This modification <br />should be reflected in at least two locations in the permit: the text of Section 2.05.2 and on the <br />Post - Mining Cross Section D -D' on Map 2.05.4 -2. In additional, potential revised impacts to the <br />Probable Hydrologic Consequences should be reevaluated. <br />2.05.3(3) — Mine Facilities <br />1. The fuel dock is described in Table 2.05.3(3) -1 as being 10' x 30' in size, with a single fuel tank. <br />Aerial photos indicate that two tanks are installed at the site, and the bermed enclosure appears to <br />be larger than the dimensions given. Please update the Table and Map 2.05.3(3) -1 to provide an <br />accurate representation of the fuel dock's dimensions and location. <br />New Horizon North Mine -5- 12/20/2014 <br />
