Box 459
Florence, CO 81226
RE: Southfield Mine, Permit C- 1981 -014
Adequacy review of TR -44, request to designate Pond 5 as permanent
Dear Mr. Patterson:
The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed the TR -44
application and our associated Rule 4.05.9(13). We have identified two adequacy issues.
1. Regarding water quality in the pond and the post- mining land use of rangeland and wildlife
habitat, we require that you take a grab sample of the water in Pond 5 and have it analyzed
for constituents to meet agricultural standards (see our Rule 4.05.9(13)(a)). You can find the
applicable constituents in Table I, Table II, and Table III in Regulation No. 31, "The Basic
Standards and Methodologies for Surface Water" (Colorado Department of Public Health
and Environment, Water Quality Control Commission, last amended September 11, 2012).
2. Per the enclosed response from the Division of Water Resources (DWR), Pond 5 must be
approved as a Livestock Water Tank by DWR.
If you have any questions feel free to contact me at (303) 866 -3567, extension 8113.
Sincerely,
Robert Zuber, P.E.
Environmental Protection Specialist
Enclosure
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us
John W.
