COMMENTS
This was a complete inspection of the New Horizon North Mine conducted on September 18, 2014 by Mike
Boulay of the Division of Reclamation,Mining and Safety. Frank Ferris of Western Fuels-Colorado (WFC)was
present during the entire inspection. Weather conditions were warm and clear and ground conditions were dry.
WFC was hauling coal from the mine to the power plant at the time of the inspection. Drilling in preparation for
blasting the Bench 2 overburden was in progress and overburden material was being hauled from the west side of
the pit for backfilling and grading operations.
AVAILABILITY OF RECORDS—Rule 5.02.4(1):
The availability of records was checked on the morning of 9/18 prior to the ground inspection. All required
records were on file and available for review at the mine office, with exception of the Insurance Certificate. Please
update the records file with a current Insurance Certificate. No other problems were noted with the records
review. Please see the attached Availability of Records checklist at the end of this inspection report. The AVS
Annual Review Inspection was also completed on this date. On site observations were made and direct inquiry of
site personnel were conducted to verify information on the Mine ID sign,the identity of the permittee and
operator, and the MSHA ID number.

There is an overall increase in groundwater flowing into the pit from the lower end of the highwall and from the
pit bottom(see Photograph No. 1). WFC is pumping groundwater out of the pit to Pond NHN-001.
Sedimentation Pond NHN-00I was inspected and there is a significant amount of water contained in the pond,but
well below the level of the primary spillway. As noted during the June, 2014 inspection, some rills were forming
on the side slopes of the pond. These have been repaired(see Photograph No. 2). The pond repairs looked good
