EXHIBIT A—Legal Description <br /> The portion of the N%:of the S Y2 of Section 14,Township 7N, Range 44W of the 6th P.M. in <br /> Phillips County Colorado which lies within the confines of the banks of the Frenchman Creek.The pit <br /> area contains an access road in the northeast corner that runs along the north side of the Frenchman <br /> Creek. Said portion will contain approximately 9.9 acres. Delineator boundary posts will be set to mark <br /> the pit area as shown on the attached maps. <br /> EXHIBIT B—Site Description <br /> Vegetation- <br /> There is no vegetation in the actual creek bed. Native grass does occur on the banks. This bank <br /> vegetation is periodically destroyed with heavy rainfall,and the resulting creek flooding occurs. There <br /> are deciduous trees at various locations along the banks. <br /> Wildlife- <br /> No significant amount of wildlife has been encountered during any of the visits to the site. <br /> There are no known threatened or endangered species in the area. <br /> Soils Information- <br /> Soils within the proposed area is mainly Wages-Eckley-Dix(WeE)with a 5-25 percent slope. <br /> Other soils are Ra,CdB,AsB and AsC. A complete soils description and representative map is included. <br /> Structures- <br /> The only man-made structures in the proposed site are driveways and trail roads leading into the <br /> site.There are also overhead power lines on west side of the property. <br /> Water resources- <br /> The pit site is located in the Frenchman Creek.This creek is normally a dry creek,only flowing in <br /> periods of heavy rain run-off.The creek channel varies in width between 50 and 250 feet. During times <br /> of very heavy rainfall water flows through the creek bed,depositing more aggregate. Because of the <br /> rapid percolation of the creek bed,water does not stand more than a few days.The excavation and <br /> cleaning of the creek bed deposits will be such that ground water elevations will not be encountered. No <br /> existing water rights will be changed. <br /> EXHIBIT C-Mining Plan <br /> Access to the pit is located off County Road 47.Via existing trail road that follows the creek bed. <br /> The material being excavated will be used by the city for various construction projects. Sand and <br /> gravel will be mined within the banks of the creek beginning in the northern part of the creek as <br /> indicated on the map. Mining will travel both directions within the confines of the creek. Excavation <br /> will continue as it is needed.There is no overburden as the pit will be in the creek bed.Some haul roads <br /> will be created to remove the gravel.These roads will be of minimal maintenance.All access roads will <br /> not be reclaimed as request by the landowner.Stockpiling may be done in the creek bed along the <br /> extreme edges, but most all of the gravel will be hauled away at the time it is mined. No processing is <br /> planned at the site. <br />
