Early 1970s Present operations begin with underground mining at No. 5 Mine. 1974 Open Mining Permit No. 41 issued for surface mining in Williams Fork Strip Pit. 3/1977 Eagle No. 9 Mine (currently called No. 9 mine) granted Permit No. 76 -7 U.G. under C.R.S. 1973, 34 -32 -101 et seq., as amended. 3/1980 Permit No. 79 -170 issued for Eagle No. 5 and No. 9 Mines 2/17/1981 First part of original C -81 -044 permit application submitted by Empire Energy Corporation for compliance with Colorado's permanent regulatory program covering existing operations of No. 5 and No. 9 Mines. 8/14/1981 Second part of original C -81 -044 application submitted as addendum covering newly issued federal lease know as the Empire Tract. Lease covered eastward expansion of No. 5 Mine, increasing permit area by 681 acres with no new surface facilities. 4/14/1982 Third part of original C -81 -044 application submitted proposing 1,552 - acre increase to permit area and an amended plan for the No. 9 Mine. No new surface facilities were proposed. Final proposed permit acreage was 5,397 acres. 12/1982 Permit revision application submitted for consolidating information from three previous submittals into single permit application document, and for additional mining in No. 5 and in No. 9 Mines. 9/2/1983 Permit revision granted for consolidated information and for additional mining in No. 5 Mine, but not for additional mining in No. 9. 4/9/1984 Approval granted to conduct additional mining in No. 9 Mine. 4/30/1987 Permit Revision application PR1 submitted for changes in operations: implementation of longwall system, addition of 5A portal, approximate 430 -acre increase in permit area (Utah Tract), and opening a new mine, the No. 6 Mine (in the E seam, to be accessed through the 5A portal). Permit acreage increased from 6,176 acres to 6,820 acres. Surface disturbance remained at 375 acres. No further mining in P seam as No. 9 Mine had been sealed. 1/9/1988 Permit Renewal RN approved with operator change from Empire Energy Corp. to Cyprus Empire Corp.
