Intrndnctinn <br />Purpose and Scope of this Document. The Colorado Division of Reclamation, Mining and <br />Safety (the Division) has received an application from Moffat County Mining, LLC. (MCM) to <br />renew permit C -1981 -044 for conducting surface coal mining and reclamation operations at the <br />Williams Fork Mines. The Williams Fork Mines was formerly operated by BTU Empire <br />Corporation (BTU EC or BTU Empire) and RAG Empire Corporation. The renewal application <br />number is RN -06. The Division is required to make specific written findings. In accordance <br />with Section 34 -33 -114 of the Colorado Surface Coal Mining Reclamation Act and Rule <br />2.07.6(2) of the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining, <br />this document presents those findings and the Division's proposed decision regarding approval <br />of MCM's permit renewal application. The findings and proposed decision can be found at the <br />end of this document following a summary of the history of permit C- 1981 -044, a description of <br />the environment affected by the operation, and summaries of the mining and reclamation plans. <br />Replacement of Previous Findings Documents. This findings document replaces the findings <br />documents for the Williams Fork Mines; permit number C- 1981 -044 previous renewals. <br />Information Sources for Permit and Review Process. The review process for permit revisions <br />and renewals is described in the Colorado Surface Coal Mining Reclamation Act (C.R.S. 34 -33- <br />101 et seq.) and the Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining. "Rules" referred to in this document are contained within those regulations. Specific <br />information about MCM mining and reclamation operations can be found in the permit <br />application and permit revision applications on file with the Division, 1313 Sherman Street, <br />Room 215, Denver, Colorado 80203. <br />Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve MCM's <br />application for permit renewal RN -06. <br />This decision is based on a finding that the operations will comply with all requirements of the <br />Colorado Surface Coal Mining Reclamation Act, C.R.S. 34 -33 -101 etseq., and the Regulations <br />promulgated pursuant to the Act. <br />If no request for a formal hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final.
