William A. Bear
November 25, 2014
4. Please also update Map 18, Postmining Topography, to show the planned postmining topography of the
borrow area and demonstrate compliance with Rule 4.14.1(2)(a).
5. The proposed borrow area will be excavated in close proximity to power lines and the support structures for
the Bowie No. 2 Mine loadout conveyor. If the foundations of these structures were damaged, they could
fall into an area that is outside of the currently approved permit boundary, or possibly disrupt electrical
service provided by the power line. Please provide information that demonstrates that the proposed
borrow material excavation will not compromise the stability of the power line and conveyor belt adjacent
to the borrow area resulting in damage to private property (the adjacent Terror Creek Loadout facility) or
disruption of electric service (Rules 4.04(5) and (6)).
6. The reclamation costs associated with this revision will be dependent on resolution of the above issues.
Therefore the Division will provide comments regarding BRL's estimated reclamation costs after the above
issues have been resolved.
If you have any questions or need additional information, please contact me.
Sincerely,
Susan L. Burgmaier
Environmental Protection Specialist
cc: Tamme Bishop, J.E. Stover & Associates
