Franson Family Partnership, <br />A Limited Partnership <br />49627 County Road L <br />Yuma, CO 80759 <br />(970) 848 -2950 <br />November 3, 2014 <br />Washington County <br />Board of County Commissioners <br />150 Ash St <br />Akron, CO 80720 <br />RE: Damage Reimbursement Agreement <br />Franson Pit - Permit # M- 2014 -051 <br />Dear Commissioners: <br />HAND DET-TVF.RF.D <br />Franson Family Partnership, a Limited Partnership, has filed an application for a Limited Impact Permit <br />with the Colorado Mined Land Reclamation (MLR) to extract construction materials from a tract of land <br />located in part of the NW' /4, Section 31, T -5 -N, R -48 -W, 6th Principal Meridian, Yuma County, <br />Colorado. <br />State MLR law requires the permit applicant to agree to reimburse the owner of any permanent man -made <br />structure(s) within 200 feet of the mining area for damage done to the structure(s) as a result of the <br />permitted operation. We believe Washington County own the structure listed below. Franson Family <br />Partnership agrees to reimburse Washington County for any damage done to the structure listed below as <br />a result of the proposed mining operation. Your acknowledging signature and a notary seal in the spaces <br />provided below should satisfy the MLR law reimbursement requirement. <br />Please return this agreement within 30 days of receiving it if at all possible. Enclosed is a stamped <br />addressed envelope so you can return the executed agreement to us. We have also enclosed a second <br />copy of this letter that you may keep for your files.
