Although this area is designated as a disturbed area and topsoil has been removed, it may be <br />beneficial to temporarily vegetate this strip of new disturbance to reduce the amount of runoff reporting to the <br />ditches and culverts, thereby reducing erosion and ultimately the amount of sediment reporting to Pond B. BRL <br />should be cognizant of any MSHA concerns with vegetation in the vicinity of the conveyor belt, and maintain <br />compliance with MSHA requirements. If vegetation establishment would be consistent with MSHA requirements, <br />hand seeding is recommended due to safety concerns with operating equipment on this steep slope. <br />SIGNS AND MARKERS Rule 4.02: <br />Disturbed area boundary markers had been recently placed around the rockfall berm above the main fan bench. <br />Placement of these markers completed replacement of all of the missing markers identified during the October and <br />November inspections. During this inspection, however, it became apparent that disturbed area markers were <br />missing southwest of Pond B. Markers should be installed southwest of Pond B within two weeks of the issuance <br />of this inspection report. <br />The operator had completed modification of permit identification signs to include the full permit number (C -1996- <br />083 vs C -96 -083). One sign, off of Highway 133 (near Pond J and the light use road to the loadout), had <br />apparently been missed. The Division had previously required the modification of all signs no later than <br />December 31, 2014. Accordingly this sign should be modified to display the full permit number prior to <br />December 31, 2014. <br />TOPSOIL Rule 4.06 Removal 4.06.2; Substitute Materials 4.06.4(4); Storage and Protection 4.06.3; <br />Redistribution 4.06.4: <br />Topsoil salvage and redistribution operations had been shut down for the winter and Topsoil Stockpiles D, E, and <br />F had been reshaped, seeded, and mulched. <br />ENFORCEMENT ACTIONS /COMPLIANCE <br />No enforcement actions were initiated as a result of this inspection, nor are any pending. <br />Number of Partial Inspection this Fiscal Year: 6 <br />Number of Complete Inspections this Fiscal Year: 2 <br />Page 5 of 15 <br />
