Mr. Peter Foster, P.E. <br />DeBeque Pit (M2011 -054) SWSP <br />November 21, 2014 <br />Page 3 <br />this SWSP are estimated at 14.13 acre -feet for the period of August 1, 2014 through July 31, <br />2015. <br />The pit must be continuously dewatered until such time as the pit can be filled by ground <br />water infiltration during a free river period, or an amendment to the SWSP must be requested and <br />approved to include additional replacement water to offset the volume of water required to fill the <br />pit during the call period. You indicated that the pit will be continuously dewatered at a rate of 500 <br />GPM. Out of priority lagged depletions resulting from filling of the pit total 0.45 acre -feet if the <br />dewatering ceases (Table 5). Also, for the walk -away analysis you have assumed that the <br />maximum total mined area will be limited to 11.6 acres and based on the assumed 2002 call <br />period on the Colorado River below Shoshone Power Plant, out of priority lagged walk -away <br />evaporative depletions total 5.02 acre -feet (Table 6). The total out -of- priority depletions from pit <br />filling and out of priority lagged walk -away evaporative depletions are 5.31 acre -feet (Table 7). <br />Replacement <br />United has entered into a water supply contract with the Colorado River Water <br />Conservation District ( "CRWCD ") (Contract no. CW12006). Under this contract, United is <br />entitled to the delivery of 7.9 acre -feet of replacement water annually. A copy of the contract <br />was submitted on December 17, 2012 and is attached to this letter. A 10 percent transit loss is <br />assessed for the delivery of this replacement water. <br />The source of replacement water from CRWCD was identified as Wolford Mountain <br />Reservoir. Wolford Mountain Reservoir is located on the Muddy Creek drainage and it was <br />decreed by the Division 5 Water Court in case nos. 87CW283, 95CW281 and 98CW237. <br />Based on review of Colorado River call records below Shoshone Power Plant over the <br />period of record from 1987 to 2011, a call was placed on the Colorado River for 111 days during <br />the months of April through October 2002. The applicant has assumed this as a worst case <br />scenario call period. Therefore, based on the above, out -of- priority lagged depletions during the <br />term of this SWSP are projected to be 4.88 acre -feet. Assuming a 10% transit loss for the <br />delivery of replacement water results in a total required replacement amount of 5.42 acre - <br />feet/year. <br />Conditions of Approval <br />This SWSP is hereby approved pursuant to § 37 -90- 137(11), C.R.S., subject to the <br />following conditions: <br />1. This plan is approved with the effective date of August 1, 2014 and shall be valid through <br />July 31, 2015 unless otherwise revoked or modified. If this plan will not be made absolute <br />by a water court action by the plan's expiration date, a renewal request must be submitted <br />to this office with the statutory fee of $257 no later than June 15, 2015. <br />2.
