2) Reclamation Success <br />Problem/Possible Violation: Trash and refuse was noticed on the site. This is a problem <br />at this time for failure to dispose of refuse in a manner that controls unsightliness or <br />deleterious effects of such refuse pursuant to 34- 32- 116(7) (d) C.R.S. <br />As stated, vandalism has been significant at this high - elevation site. Equipment has been <br />all but destroyed and the refuse from that vandalism was significant. In August and <br />September, we spent considerable effort removing trash and destroyed trailers from the <br />site. While there is additional work to be done, after many years of vandalism and <br />neglect, we believe that the work done is quite significant and warrants the abatement of <br />this issue. We commit to continuing to clean the site and to work towards completely <br />eliminating all items of refuse from the many years of vandalism on the site. Please see <br />the attached photos of the site, before and after our efforts. <br />3) Signs & Markers <br />Problem/Possible Violation: The affected area boundary markers are missing or <br />incorrectly placed. This is a problem for failure to maintain boundary markers around <br />the affected area as required by Section 3.1.12(2) of the rule. <br />The permit boundary delineation has been a long standing issue and we reviewed the <br />DRMS permit file for reference. The original permit application, received by the DRMS <br />on January 26, 1983, states that the "Total surface acreage to be included in the permit" is <br />'Not more than .35 acre of disturbed surface ". Exhibit B of that application states that <br />the "Graded Work Area" is dimensioned at "About 125' by 125 "'. No monuments were <br />found matching the locations described in the sketches or permit map ( "Exhibit C ") of the <br />original submittal. No permit amendments or modifications have been found to further <br />clarify the permit boundaries. On October 17, 2014, we placed 6' metal t -posts at the <br />corners to delineate the permit area, as described in the original permit application. The <br />t -posts were surveyed and a map of their locations is attached. Please see attached photos <br />of these boundary markers. The area delineated is generally consistent with the Exhibits <br />and description of the permitted disturbance areas. The area delineated is approximately <br />116' by 133', or 0.35 acres and appears to include the area disturbed by mining activity <br />under the permit. <br />4) Additional Contact <br />I have enlisted the aid of Mr. Matt Collins, a degreed mining engineer and experienced <br />mine operator, in working towards improving the status of the mine and permit.
