GEORGE E. OTTEN
11438 County Road 19 A /
Fort Lupton, CO. 80621
(970)785 -2538
RECEIVED
November 17, 2014 ,/
"NOV 2 J 7.014
Mr. Michael Cunningham DMSION OF RECLAMATION
Division of Reclamation, Mining and Safety MINING AND SAFETY
1313 Sherman St., Room 215
Denver, CO 80203
RE: Inspections and Violations, Permit M1984 -013, Abatement
Dear Mr. Cunningham,
Despite my previous statements regarding my ambivalence about the continuance of this
permit, I believe that it is in everyone's best interest if the permit does not proceed to
cancellation and bond revocation as a result of the outstanding permit violations and my
previous inability to resolve them. I have addressed the issues that led to permit
violations at the Mackey Mine (DRMS Permit 4M1984 -013) and hope that the DRMS
can withdraw its position with the Mined Land Reclamation Board that the permit should
be terminated and the bond revoked. It is my hope that the DRMS finds the following
information sufficient for this to occur.
1) Gen. Compliance With Mine Plan
Problem/Possible Violation: The adit portal presents a saftey hazard and must be
adequately safeguarded to prevent entry from the public.
Due to its somewhat remote and isolated location, the property has a long history of
vandalism and previous efforts to secure the portal have often been unsuccessful. We
have taken efforts to secure the portal from unauthorized entry by installing three (3)
heavy timbers (3" x 10" rough douglas fir) horizontally in the outby portal set. These
timbers are backed by a diagonal timber (of the same dimensions). The timbers are
installed with modern hexagonal head timber screws (6 ", 8" and 10" in length). The 3/4"
plywood doors were then screwed to the timber and the portal set using 2 -1/2" wood
screws and 6" timber screws. New signage was installed on the door. History has shown
that trespassers have been able to break into the mine, despite previous efforts. With the
onset of winter and heavy snow at the site, we believe the efforts taken will be effective
and we will evaluate the portal in the spring, after the snowmelt. Please see the attached
photos of this work.
Mr. Michael Cunningham 11/18/2014
Division of Reclamation, Mining and Safety Page 1 of 15
Violations and Abatement — M1984 -013
