and check on Mr. Fontanari's irrigation ditches. As you are aware, Mike Boulay called Mr. Fontanari <br />yesterday afternoon and asked that he discontinue flow in his ditches. I arrived at the site at 9:30 this <br />morning and noted that the irrigation water in both the upper and lower irrigation ditches had ceased <br />flowing. I then checked Outfall 016 and it was flowing at 274.3 which is an average flow. I then drove up and <br />checked on the flow from the seepage at the South Portal area. It appeared to be the same flow as we <br />observed yesterday (approx. 45 to 60 gpm) and the damp area on the southern portion of the portal backfill <br />(where the backfill abuts the natural geology) has not increased. There is still the same small seepage from <br />under an existing concrete wall on the north side of the portal backfill. I am meeting with Mike Berry, P.E., <br />with Huddleston -Berry at the portal site today at 4:00 p.m. to get his professional assessment of the <br />situation. I have forwarded both of your a -mails to Snowcap Coal Company management and am waiting to <br />hear their response /directions in regards to your latest e-mail. Please provide an update regarding any Snowcap Coal Co., Inc. <br />activities to assess and mitigate the situation. <br />DRMS remains concerned that immediate action is needed. Unless DRMS can be assured today that that there <br />is no risk to public health and safety, we will need to notify CDOT and any other potentially impacted entities of <br />the situation. If necessary, these notifications will occur later today. <br />DRMS is again requesting that Snowcap implement any actions necessary to safely assess and mitigate the <br />water accumulation at the South Portal mine seal, and we reiterate our message of last evening. <br />
