Application of Bowie Resources, LLC <br />Application for Conditional Water Right and for <br />Conditional Appropriative Right of Exchange <br />Page 7 <br />The exchange amount will equal the difference between the predicted average daily <br />streamflow at the lower monitoring station and the measured average daily streamflow at <br />the lower monitoring station, plus necessary transit losses, if any. The release will result <br />in increase in flow at the lower monitoring station to the predicted range. Alternatively, <br />or in addition to this action, the Applicant will construct a pipeline conveyance system <br />within the exchange reach for the purpose of reducing, or eliminating, the volume of <br />substitute supply that otherwise would be necessary to effectuate the exchange. Such <br />release of substitute water supply and /or pipeline use will cease if, and when, the average <br />daily streamflows, as measured at the lower monitoring station, return to the expected <br />range of flows as defined by the 95% confidence interval for five (5) consecutive days. <br />Additional information relating to the exchange procedure, including an example of the <br />how the proposed exchange procedure will operate based upon the data collected as of <br />July 2014, is attached as Exhibit A. <br />Implementation of the proposed West Fork Terror Creek exchange, including the <br />construction and operation of the temporary pipeline diversion and conveyance system <br />within the exchange reach, will prevent possible injury to other water right owners within <br />the Terror Creek basin. There are no decreed water rights diverting from West Fork <br />Terror Creek within the proposed exchange reach. <br />WHEREFORE, Applicant requests that the Court enter a decree awarding the <br />conditional water right for the Bowie Spruce Stomp Diversion as described in the First Claim <br />above; awarding the appropriative right of exchange described in the Second Claim above; and <br />awarding such other and further relief as may be just and proper. <br />Dated: July 30, 2014 <br />WILLIAMS, TURNER & HOLMES, P.C. <br />B y VO4,4 C <br />Mark A.
