The applicant has undergone five separate Section 7 consultations for at total
of 326.7 acre feet per year. Please refer to Biological Opinions dated Sept. 3,
1996, Dec. 10, 1999, Oct. 23, 2001, July 29, 2003 and March 31, 2004 for
123.6, 113.0, 20.3, 69.0 and 0.8 acre -feet respectively.
The Bowie No. 2 Mine obtains its dust suppression and sanitary water from
the Deer Trail Ditch via the pump station located on the Deer Trail ditch.
The applicant holds a water right to use 0.5 cfs decreed to the Deer Trail
Ditch for power and mining purposes with the date of appropriation of
February 15, 1907. Full time use of this water right would supply the mine
with 362 acre -feet of water. Therefore, the applicant has water rights
adequate to supply the water consumption for the Bowie No. 2 Mine.
