Compliance With Mine Plan <br />N - Support Facilities Not On -site <br />N - Other <br />N - Special Categories Of Mining <br />N - Processing Waste <br />R - Topsoil <br />COMMENTS <br />This was a complete inspection of the New Horizon North Mine conducted by Brock Bowles, Dan Hernandez and <br />Clayton Wein of the Colorado Division of Reclamation Mining and Safety. Frank Ferris of Western Fuels - <br />Colorado (WFC) was present during the entire inspection. The weather was clear, sunny, cool with no wind. The <br />ground conditions were dry. Coal was being hauled to the power plant at the time of this inspection. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />The availability of records was checked in the morning before the ground inspection. The insurance <br />certificate has been updated since the last complete inspection. A well permit for the water well by the facilities <br />area needs to be included in the permit. See the availability of records checklist at the end of this inspection <br />report. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Pond NHN -001 contained some water but was not discharging. The emergency spillway was free and <br />clear of obstructions (photo 1). The primary spillway was free and clear of obstructions and the weep hole valves <br />were closed (photo 2). <br />The rock in the east ditch noted in the Oct 2014 inspection had been removed. The shrubs growing in the NHN- <br />001 East ditch need to be cut or mowed so they will not create a debris dam. <br />The water pump at the NH1 Pond is in a rubber lined `pan' to contain spills (photo 3). <br />The 12 monitoring wells in the field were located and matched to the well permits in the permit (photo 4). <br />Number of Partial Inspection this Fiscal Year: 4 <br />Number of Complete Inspections this Fiscal Year: 2 <br />Page 2 of 5 <br />
