The weather was fine and dry. One permitting action is in progress, it is detailed under the <br />heading GENERAL MINE PLAN COMPLIANCE. For a more complete description of the state of New Elk Coal <br />Company refer to the inspection report for the New Elk mine. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />The technical services building at the New Elk mine was in the process of being prepared for return to the <br />company it was leased from. The records had been moved to a new office, to be occupied by John Terry and Ron <br />Thompson, next to the east entrance to the workshop building. The records were generally in good order, but some <br />files had not been updated and the recent move made the customary piles of loose papers harder than usual to <br />locate. Detailed comments are made at the end of this report. <br />EXCESS SPOIL and DEVELOPMENT WASTE — Rule 4.09 <br />Placement; Drainage Control; Surface Stabilization: <br />Fills 7, 8 and 9 appeared stable and well vegetated. There were no signs of erosion or drainage problems. <br />Repairs had been made to a contour ditch on fill 8, but it did not appear as though the repair had been reseeded. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />All the ponds (5, 6, 7, 8, 9 and 9a) were holding a little water, but none were discharging. The pond <br />embankments and spillways all appeared to be in good order.
