Please demonstrate that the method used <br /> to place the inert fill will support the post-mining land use of commercial/industrial. ( Note: <br /> DRMS believes that uncontrolled backfill is not generally compatible with future development <br /> that would require properly placed structural fill under utilities and structures. Additionally, with <br /> thick sections or large pieces of inert material, issues like soil piping and preferential subsurface <br /> drainage patterns can become problems in the future.) <br /> 6.4.6 EXHIBIT F-Reclamation Plan Map <br /> 16)The final grading depicted on the reclamation plan map shows a slope steeper than 3H:1 V <br /> between phase 1 and phase 2. Please re-submit the reclamation plan map depicting the final <br /> topography with slopes 3H:1 V as described in the reclamation plan. <br /> 17)Please provide two reclamation plan maps depicting the final topography and post-mining land <br /> use for Option 1 and for Option 2. <br /> 6.4.8 EXHIBIT H-Wildlife Information <br /> 18)Please demonstrate that there are no threatened or endangered species from either federal or state <br /> lists, inhabiting the proposed affected land. DRMS believes there is potential for threatened or <br /> endangered species to inhabit the prairie dog colony located on the proposed affected land. <br /> DRMS recommends the applicant perform a wildlife survey. <br /> 19)Please demonstrate that the prairie dogs will be removed in compliance with all applicable laws. <br /> 6.4.19 EXHIBIT S -Permanent Man-made Structures <br /> 20)Please provide any of the following for all the permanent man-made structures located within <br /> two hundred(200) feet of the affected land identified in permit application: <br /> a. provide a notarized agreement between the applicant and the person(s) having an interest <br /> in the structure, that the applicant is to provide compensation for any damage to the <br /> structure; or <br /> b. where such an agreement cannot be reached, the applicant shall provide an appropriate <br /> engineering evaluation that demonstrates that such structure shall not be damaged by <br /> activities occurring at the mining operation; or. <br /> c. Where such structure is a utility, the Applicant may supply a notarized letter, on utility <br /> letterhead, from the owner(s) of the utility that the mining and reclamation activities, as <br /> proposed, will have "no negative effect" on their utility. <br />
