Weather <br />conditions at the time of the inspection were sunny and warm; ground conditions were dry. <br />The permit for the Bear Mine has been revoked and the reclamation performance bond has been forfeited. The <br />Abandoned Mined Land program of DRMS will contract with a third party to complete the remaining reclamation <br />tasks for the site. <br />BACK-FILL and GRADING Rule 4.14m Contemporaneous Reclamation 4.14.1; Approximate Original Contour <br />4.14.2; Highwall Elimination 4.14.1(2) 69; Steep Slopes 4.14.2, 4.27; Handling ofAcid and Toxic Materials <br />4.14.3; Stabilization of Rills and Gullies 4.14.6: <br />The backfilled and graded slope on the east end of the portal road was stable and well vegetated. The west end of <br />the slope, where the 1997 Edwards Portal slide occurred, did not show any signs of any recent major movement. <br />HYDROLOGIC BALANCE - Rule 4.05, Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage —Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The sediment pond held very little water such that the bottom of the pond was merely damp. The treatment pond <br />was full and discharging to the North Fork of the Gunnison River. The Edwards Portal spring was flowing from <br />the portal slide area to the treatment pond. <br />Alluvial monitoring well AA -3, thought to have been reclaimed by the operator, was located along the flood <br />control berm, east of the treatment pond. The AML program of the Division will be notified that this well will <br />need to be reclaimed along with well AA -1. <br />ROADS Rule 4.03, Construction 4.03.1(3)14.03.2(3), Drainage 4.03.1(4)14.03.2(4), Surfacing and <br />Maintenance4.03.1(5) and (6)14.03.2(5) and (6) Reclamation 4.03.1(7)14.03.2(7): <br />The access road to the site from Highway 133 was passable and in fair condition.
