OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Hydrologic Balance and Off -site Damage <br />PROBLEM: Alluvial groundwater is mounding against the backfill of fines at the Worthing Pit, which is <br />contributing to upgradient groundwater mounding between the Stagecoach Pit and Pit 29. This is a problem for <br />failure to minimize the disturbance to the prevailing hydrologic balance pursuant to C.R.S. 34 32.5116(4)(h) and <br />for failure to protect areas outside of the affected land from slides or damages occurring during the mining <br />operation pursuant to C.R.S. 34- 32.5- 116(4)(i). <br />CORRECTIVE ACTIONS: Submit to DRMS by November 10, 2014 a Technical Revision to the permit, <br />containing the groundwater mounding mitigation plan described in your letter that DRMS received on September <br />30, 2014. The plan must include: <br />1) A detailed description of the measures the Operator will take to reduce groundwater mounding outside of <br />the Worthing Pit to a level that eliminates elevated groundwater levels in the surrounding area, <br />2) A time schedule for implementing the plan, and <br />3) Enough information for DRMS to estimate the cost of implementing the plan (for establishing the amount <br />of required financial warranty). <br />CORRECTIVE ACTION DUE DATE: 11/10/14 <br />Page 1 of 7 <br />
