TR-07 MINING PLAN <br /> Processing of the Mined Materials <br /> Processing of the mined sand will occur at the processing plant location. Some sand mined at the <br /> site may not be processed on site, but may be hauled to off-site locations where it is processed. Those <br /> other locations are elsewhere in the Denver metropolitan area and quite distant from the Coal Creek <br /> mining area. Off-site processing locations are therefore not affected land. <br /> Processing will primarily involve sorting and washing operations. No crushing occurs at the site as <br /> rarely are the particle sizes large enough to require it be crushed to produce a product. Water for the <br /> processing is obtained by purchase from wells located on the site and owned by other parties. No water for <br /> washing is obtained from Coal Creek itself as Coal Creek rarely has a flow volume sufficient to supply the <br /> needs of the wash plant. When it does it is the result of a large thunderstorm and the water is then <br /> completely unsuitable for use in washing. <br /> Settling ponds are used to capture the fines washed out of the sand. These ponds are periodically <br /> cleaned out. On occasion a customer may want to purchase some of these fines, but that is a very rare <br /> occurrence as the fines are suitable for only very specialized purposes. A vast majority of the fines <br /> removed from the ponds are hauled back to the mining pits and used in the backfill process. Storage of the <br /> fines after they are removed occurs adjacent to the ponds. During this period the fines are allowed to drain <br /> and dry before they are hauled back to the mining pits for backfilling. <br /> Stockpiling of the finished product produced occurs adjacent to the processing plant. The final <br /> product is supplied from these stockpiles. However, some products are actually pit run products produced <br /> from specific mining pits where the existing sand meets certain specifications. In those cases, no <br /> processing of the sand occurs. Instead the customer's trucks are loaded at the mining pit itself and the <br /> material hauled directly to the location where the customer is using the material. <br /> Initial Mining Areas <br /> As a result of the lease modifications, only one area remains to be mined. Mining in this area has <br /> been initiated. It was established in compliance with the high ground to low ground(south to north) <br /> operational pattern required by the previous plan. All that remains is to continue mining this single area <br /> until either the approved land runs out or the lease concludes. Therefore, the previous discussion of initial <br /> mining areas and how they are established is no longer relevant and has been deleted from this plan. <br /> Consideration of Other Lessees <br /> REQUIREMENT 18: No operations will occur within 200 feet of any operating oil <br /> or gas well or oil or gas lines without FIRST obtaining permission from the well or pipeline owner and the <br /> additional disturbance is also APPROVED by the Colorado State Board of Land Commissioners and the <br /> Coal Creek Sand Resource Amendment 3 (2005)- M-1988-044 Exhibit D Page 14 <br />
