Mr. Lance Barker <br /> October 20, 2014 <br /> Page 3 <br /> permitting over two existing NOIs(P-1986-023 &P-1986-036) and one mine reclamation <br /> permit(M-2004-064),the Division needs clarification as to how much of the 4.4 acres are <br /> roads that need to have safety berms removed and how much is waste dump that will <br /> require re-contouring for reclamation and re-establishment of vegetation. Please provide a <br /> breakdown for the area of roads that will have safety berms removed and will not be <br /> vegetated(as they are historic roads), versus waste dump areas that will be reclaimed and <br /> revegetated. The Division needs to have both volumes of material (for earth moving)and <br /> areas (for final grading and seeding) to estimate a proper financial warranty for <br /> reclamation. Volumes should be addressed in Comment 8 below. <br /> 7. Paragraph l(k-1)—The response states the project is located within the diatreme, also referred to as <br /> the "Cripple Creek Breccia". The Division's documented knowledge of the diatreme does not <br /> include the project area. Please provide the Division with documentation that the project area is <br /> within the diatreme. <br /> a. Please confirm whether or not water will be used... The response is adequate. The <br /> Division understands that blasting will be underground and is not concerned with the <br /> water use in that sense. Should water be used in the rock size reduction process on the <br /> surface at a later time, a revision to the permit may be required. <br /> b. How are crusher fines handled ... The response is partially adequate. Based on the acid <br /> production test results for Sample MH-3 (received 9/26/2014), it appears possible to have <br /> acid generating material produced at the mine. Please describe how waste rock is to be <br /> separated from ore and specify how and where each will be stored (i.e., above or below <br /> ground,estimated time for temporary vs.permanent storage). <br /> 6.3.4 EXHIBIT D—Reclamation Plan <br /> 8. Paragraph (b) — Please commit to a maximum slope ... The post-mine land use is rangeland. <br /> Reclaimed slopes must be consistent with the post-mine land use and able to support rangeland <br /> vegetation. The Division believes 1 to 1.5H:1 V slopes are too steep to support rangeland <br /> vegetation and prevent erosion. The response is unacceptable without photographic and <br /> topographic demonstration of the successful growth of grasses on I to 1.5H:I V slopes as stated in <br /> Mr. Braun's response to Comment 9. The Division asserts that as this application is permitting over <br /> three different approved permits, the original reclamation commitments must be retained unless <br /> compelling arguments can be made for changing the original reclamation objectives. The following <br /> summarizes the existing site reclamation commitments and status: <br /> ■ Mineral Hill surface exploration (P-1986-023) — The approved 1986 reclamation plan for <br /> the surface exploration was to backfill trenches and drill pads, then recontour and reseed <br /> them. In 1989, the Division concluded backfilling and final grading were adequate, but that <br /> revegetation had not been established. The Division has not been provided with any <br /> documentation that additional surface exploration disturbances were created since that <br /> time. Therefore, any trenches and/or drill pads will need to be reclaimed by the Applicant. <br /> ■ Mineral Hill exploration drift (P-1986-036) — The current waste dump has grown since the <br /> approval of the original NOI.
