STATE HIGHWAY ACCESS PERMIT #399056 June 7, 1999 <br />Issued to Bowie Resources. Inc. <br />TERMS & CONDITIONS <br />1. This permit is issued in coniunction with Permits Jis 399055 and 7fe ?99057. Submittal for design shall include <br />considerations for all of these permits. (only one submittal required) If there are any questions re~ardins this <br />permit. please contact Mike Smith at (970) 148-7231. <br />'_. The Pernti«ee shall desi~en and submit for approval a left turn deceleration and acceleration lane 16 feet in width in <br />conformance with section ~ of the State Highway Access Code, 2CCR 60I <br />3. The Permittee shall design and submit for approval a right turn deceleration and acceleration lane 12 fee[ in width <br />in conformance with section 4 of the State Highway Access Code, 2CCR 601-I. <br />4. Design of this access with auxiliary lanes shall include, a[ a minimum. I'h-inch overla}•. <br />5. A Notice to Proceed. CDOT Form 1165 is required before besinning the construction of the access or any activity <br />within the highway right-of-H•ay. All submittals. documents, plans and other items that must be completed, shall <br />be submitted~and approved before a Notice to Proceed will be issued. Contact the Department (or local issuing <br />authority) for the Notice to Proceed. <br />6. The following items aze required before a Notice to Proceed will be issued: <br />(a) Construction Plans Stamped by a Colorado Registered Professional Engineer. <br />(b) Certificate of Insurance Liability as per Section 2.3(I 1)(h) of the Access Code. <br />(c) Traffic Control Plan <br />7. The Permittee shall refer to all additional s[andazd requirements on the back of this permit and any enclosed <br />additional terms. conditions. exhibits and noted attachments. <br />8. This Permit is issued in accordance with the State Highway Access Code (2 CCR b01-1), and is based in pan upon <br />the information submitted by the Permittee. This permit is only for [he use and purpose stated in the Application <br />and Permit. Any changes in vaffic volumes or type, drainage, or other operational aspects may render this permit <br />void, requiring a new permit to be applied for based upon existing and anticipated future conditions. <br />9. Nothing in this permit shall prohibit the chief engineer from exercising the right granted in CRS 43-3-102 <br />Including but not limited [o restricting left hand toms by construction of physical medial sepazations. <br />11. All costs associated with the installation of traffic ligha for this access are the responsibility of [he Permittee. This <br />includes but is not limited to the design, consruction, utility relocation, testing of materials and inspection. <br />11. ll%a[er, sanitary, sewer, gas. elecu-ical, communication, landscaping, and telephone installations will require <br />individual additional permits. <br />13. The Permittee is responsible for obtaining any necessary additional federal, stale and~'or City/County permits or <br />clearances required for construction of the access. Approval of [his access permit does not constitute verification <br />of this action by the Permittee. <br />14. Any work within State Highway right-of-way shall begin after 8:30 A.M. and all work and equipment shall be off <br />the highway BEFORE 3:30 P.M. each day. <br />15. No highway lane closures or one-way traffic will be allowed. <br />16. No work will be allowed at night, Saturda}•s. Sundays and legal holidays without prior authorization from the • <br />Department. The Department may also resvict work within the State Highway right-ot-way during adverse <br />weather conditions. <br />
