FRANK BERGNER, JR <br />The purpose of this letter is to alert the Division of Mining Safety and Reclamation to <br />certain practices of Aggregate Industries -WCR that are harming the public. <br />On April 22, 2014, Karen Weber- Smith, my client, was driving to work northbound on <br />Highway 285 near Morrison, Colorado, when her car was struck by rocks flying out of an <br />uncovered quarry truck transporting aggregate materials. One of the rocks struck and broke her <br />windshield. The truck's license plate was covered in dirt. The truck had entered Highway 285 <br />from Highway 8. The trucks frequently travel this stretch of highway, and she was able to track <br />them back to Aggregate Industries' crushed stone quarry three miles from the location of the <br />incident.
