PERMIT#:M-1986-074 <br /> INSPECTOR'S WITIALS:ERR <br /> INSPECTION DATE:October 6,2014 <br /> father to the west.Between the stripping area and the lay-down area was the digface/highwall which was nearly vertical <br /> and approximately 35 feet tall;the approved mining plan states that the mining slopes would be kept no steeper than <br /> 2H:1 V to minimize the public health hazard. <br /> During the inspection,it became apparent that the marked boundary corners did no correlate with the approved permit <br /> boundary depicted in the Exhibit C Map of the permit,received June 2, 1986;a copy of this map has been attached.The <br /> incorrectly placed markers will be cited as a problem requiring corrective action,please see page 1 of this report for more <br /> information.The lack of proper permit boundary markers was cited as a problem on the Division's previous site <br /> inspection on September 6,2012.The Division did not receive proof that the corrective action was resolved by the <br /> November 6,2012 due date. <br /> The Division walked the disturbance boundary with the Trimble Juno 3B GPS unit and prepared the attached map with <br /> the data.The blue line is the permit boundary marked in the field(please note that the northeast and northwest corners are <br /> approximate),the red line is the disturbance boundary,the yellow line is the approved permit boundary(determined by <br /> using distances from adjacent county roads listed on the Exhibit C Map),and the dotted black line is possible mine <br /> disturbance within the permit boundary.This possible disturbance area looked to have been undisturbed for many years, <br /> but was obviously disturbed at one time due to mining;there was an old highwall present and stockpiled material at the <br /> top of the highwall. Since this area is within the permit boundary,the reclamation plan and standards apply for this <br /> disturbance.Total disturbed area(red and dotted black lines)is approximately 11.09 acres;total disturbed area outside <br /> of the approved permit boundary is 8.59 acres. <br /> The Division considers mining more than 2 acres outside of the approved permit boundary as a violation for mining <br /> without a permit.A Reason To Believe letter that a violation exists will be sent with this report and as a possible violation, <br /> will require a hearing before the Mined Land Reclamation Board. <br /> The Division will evaluate the current financial warranty amount held for reclamation and determine if the amount is <br /> sufficient to cover the reclamation costs of the entire disturbance area. <br /> Photographs taken during the inspection are attached. <br /> Page 3 of 9 <br />
