PERMIT#:M-1986-074 <br /> INSPECTOR'S INITIALS:ERR <br /> INSPECTION DATE:October 6,2014 <br /> INSPECTION TOPIC: Off-site Damage <br /> PROBLEM/POSSIBLE VIOLATION: Possible Violation: Land has been affected outside of the approved permit <br /> boundary. This is a possible violation at this time pursuant to: C.R.S. 34-32.5-109(1)for failure to first obtain <br /> from the board or office a reclamation permit prior to engaging in a new operation. <br /> CORRECTIVE ACTIONS:This possible violation will require a hearing before the Mined Land Reclamation Board. <br /> The schedule and other details for the MLRB hearing will be provided under a separate document to be sent via <br /> certified mail to the operator. <br /> CORRECTIVE ACTION DUE DATE: 11/19/14 <br /> OBSERVATIONS <br /> The Division of Reclamation,Mining and Safety(Division)conducted an inspection of the Dollerschell Pit,Permit File <br /> No.M-1986-0074,operated by Kym A. Schure.The mine is located approximately 5.5 miles west-northwest of Sterling, <br /> Colorado. Elliott Russell of the Division inspected the site and Rob Kircher,with Cornerstone Construction&Excavating, <br /> the mining contractor of the site,accompanied the inspection.The Operator was contacted prior to the inspection,but <br /> declined to accompany the inspection.The site is an active 110c operation with 9.9 permitted acres and the approved post- <br /> mining land use is rangeland and wildlife refuge. <br /> This inspection was carried out after the Division received a formal complaint,on October 2,2014, from Robert and <br /> Deborah Hradecky who are adjacent landowners to the mine site.The citizen compliant letter involved the placement of <br /> mined material on the adjacent landowner's property causing damage to a fence line and creating a safety hazard for the <br /> landowner's children.The adjacent landowners were unable to accompany the inspection. <br /> At 09:00,the Division met Mr.Kircher at the mine site entrance on the south side of CR 32,2200 feet from CR 29.At the <br /> time of the inspection it was warm,the weather was clear,and the ground was dry.The mine site identification sign was <br /> observed on at the entrance and was in compliance with Rule 3.1.12(1).Mr.Kircher stated that the permit boundary was <br /> marked by wood lath with flagging.The Division observed several of the marked comers,but could not find the northeast <br /> and northwest comers.The locations of all the corners were taken with a Trimble Juno 313 GPS unit,including the <br /> approximate locations of the two missing comers.The site was actively being mined at the time of the inspection and one <br /> front-end loader,one bulldozer,and one tractor with two towed-scrapers were on site. <br /> The Division investigated the area that the complaint regarded.The damaged fence had been removed and Mr.Kircher <br /> stated that the material had been graded back into the mine site.He also stated that he contacted the Hradeckyes and said <br /> he would replace the fence and reclaim the area disturbed.The Division observed a small area,approximately 50 sq.ft., <br /> which had been recently disturbed and re-graded on the southeast corner of the Hradecky's property near the lath <br /> depicting one of the northeast comers of the site.Mr.Kircher stated the area would be seeded this fall and possibly re- <br /> seeded in the spring of 2015. <br /> The Division contacted Kyxn A. Schure and Rob Kircher on October 7,2014 and informed them a problem would be cited <br /> in this inspection report regarding the fence line because the mine's highwall(approximately 35 feet tall)was within 15 <br /> feet from the Hradecky property line and poses a safety hazard.The Operator has until Friday,October 10,2014,to install <br /> an adequate safety fence in this area;please see page 1 of this report for more information. <br /> After the investigation of the complaint,the Division continued with a normal monitoring inspection of the Dollerschell <br /> Pit.The,site consisted of a large lay-down area in the northeast portion of the site which contained mining equipment and <br /> stockpiles.This area consisted of 5 separate stockpiles;one of these was,Mr.Kircher stated,had been imported to the site <br /> from a nearby highway construction project.They blend this material with sand/clay mined at the site to make foundation <br /> fill.The Division estimates that approximately 7,000 C.Y.of this imported material is on site.This operation of importing <br /> and blending is not in the approved mine plan and a revision to the permit will be needed.In the southwest portion of the <br /> mine site,up on top of the hillsidetridge,there had been approximately 5 feet of topsoil and overburden stripped and piled <br /> Page 2 of 9 <br />
