Revised page 2.05 -16 indicates that MCM will provide <br />documentation from the State of their concurrence with permanent <br />retention of these roads. According to this paragraph, the roads intended <br />to be left in place are primarily located on lands owned by MCM or State <br />land but not exclusively. Please revise this statement to indicate the prior <br />to seeking bond release, documentation for road retention required by <br />Rule 4.03.1(1)(f) and 4.03.2(1)(g) will be submitted to the Division and <br />included in the permit through a revision. This will need to include <br />concurrence from any landowner who own land which the intended roads <br />are located. <br />c. MCM Response: The referenced text section has been revised to address the <br />revision requirements of Rule 4.03 and to be inclusive of any affected owners. . <br />d. DRMS Response: This item is resolved. <br />Rule 2.05.4 -- Reclamation Plan <br />2) On the currently approved Reclamation Plan Map; Map 29 it is difficult to determine <br />which areas will be reclaimed to the following post mine land uses: Rangeland/Wildlife, <br />Cropland and Pasture Land. On the revised map discussed on the previous item, clearly <br />delineate which portions of the affected area will be reclaimed to the designated post <br />mine land use. <br />a. MCM Response to items 2 through 3: In order to provide all relevant <br />information, MCM will retain the existing Reclamation Plan Map, and add the <br />updated Reclamation Map as Map 29a. As appropriate, text references have been <br />modified to reference both maps. Page 2.05 -31.2 has been revised to include the <br />previously provided information, and the revised page is included with these <br />responses. <br />b. DRMS Response: <br />i. Item #1 is resolved. <br />ii. Item #2 was not addressed. This item remains outstanding and will need <br />to be addressed prior to the approval of TR36 and RN6. <br />iii.
