On 7/2/2014, JHB sent RDZ a memo defining which adequacy items from the Division's <br /> 3/28/2014 Preliminary Adequacy Review were resolved and which needed additional <br /> information. Once again JHB stated that: <br /> • EFCI needs to establish an approved loadout reference area or reclamation standards in <br /> accordance with Rule 4.15.7(2)(d). <br /> RDZ send another adequacy letter to EFCI on 7/3/2014 which restated item No. 10: <br /> • EFCI needs to establish a replacement reference area or propose acceptable reclamation <br /> success standards for the load out and update applicable text in Section 2.04.10 in the <br /> PAP. Related revision TR-41 has been found incomplete; when sufficient information <br /> for the TR is provided,the Division will consider this issue resolved. <br /> EFCI sent responses to RN6 adequacy on 8/28/2014. <br /> • In response to Item 910, EFCI stated, "EFCI is in receipt of the Division's decision that <br /> Technical Revision No. 41 (TR-41) as previously submitted was incomplete. <br /> Subsequently, evaluation of likeness comparison of reference areas has been composed, <br /> approval letter from the surface owner has been received and accordingly, TR-41 is being <br /> resubmitted for the Division's review." <br /> EFCI submitted additional information for TR41 on 9/2/2014. The Division is evaluating this <br /> latest submittal to determine if TR41 is complete for filing. Even if the Division finds TR41 <br /> complete, the 9/2/2014 submittal is inadequate, and will require additional information from <br /> EFCI. Therefore, since TR41 has not been approved, item A10 remains unresolved. <br /> 2 <br />
