A report summarizing the survey shall be submitted within <br />30 days of the survey, and must include a statement of whether <br />the volume of available material is sufficient to meet the <br />requirements of Rule 4.10.4(5) and the material balance in the <br />currently approved permit application package. <br />36 <br />Bowie Resources, LLC must submit a plan for vibrating wire <br />TR -84 <br />CW <br />piezometer (VWP) installations on Gob Pile #3 to be approved and <br />implemented during Calendar Year 2014. <br />37 <br />Within two weeks of the proposed decision to approve, with <br />TR -87 <br />CW <br />conditions, Technical Revision No. 87, BRL must submit a revised <br />Form 1403 to clarify that the Coal Sales House is a contributing <br />feature of the King Mine. The Coal Sales House may not be <br />demolished until the form has been approved by History Colorado <br />and the Division. <br />* AC — Active, CW — Complied With, FU — Future /Ongoing, TR - Terminated <br />Section IV — Permit Variances and Specific Approvals <br />The Division has not approved experimental practices, mountaintop removal variances, <br />variances from approximate original contour (AOC), or variances from contemporaneous <br />reclamation at the Bowie No. 2 Mine. <br />Section V - Enforcement Actions <br />There have been two enforcement actions issued at the Bowie No. 2 Mine in the last two and a <br />half years since approval of the last permit renewal (RN -3). <br />Notice of Violation CV- 2013 -001 was issued on January 18, 2013 for failure to obtain a technical <br />revision for a modification to the terms or requirements of the permit for design changes for a <br />regulated structure, as required by Rule 2.08.4(2), and failure to obtain final approval before <br />implementing a technical revision, as required by Rule 2.08.4(4). During a partial inspection <br />conducted on January 9, 2013, it was observed that a roadway had been constructed across an <br />area not approved for disturbance. The operator indicated the roadway was utilized to access <br />rip rap for the East and West Diversion ditches that were previously approved for construction. <br />The disturbance was approximately 400' in length and 130' wide, totaling roughly 1.2 acres. <br />The violation was abated with the final approval of TR -76, and was terminated on February 27, <br />Page 11 of 22 <br />
