CMS 62167 <br /> CMS#65485 <br /> and other good and vahutble consideration,the receipt and sufficiency of which is hereby acknowledged, <br /> the Parties hereto agree as follows: <br /> l. Orxrator's_Obtiralions: <br /> 1.I. Operator shall promote a safe work environment at the Quarry. <br /> 1.2. Operator shall employ offender labor in the operation of a sand and gravel extraction operation <br /> at the Quarry. Operator's use of offender labor shall be primarily designed to provide offender <br /> laborers with initial and ongoing training to impart knowledge and skills in the operation of a <br /> quarry,and the equipment used in the quarry operation,including: <br /> 1.2.1. Safety procedures <br /> 1.2.2. Heavy equipment,such as earth moving and digging machinery <br /> 1.2.3. Quarry equipment,such as conveyors,sorters,and milling machinery <br /> 1.2.4. Hand operated mechanical and other manual tools and processes <br /> 1.2.5. Routine general maintenance of tools,equipment,and machinery,not to include repair <br /> 1.2.6. Quality control <br /> 1.17. Gravel crushing and screening operations <br /> 1.2.8. Any other reasonable duty commonly performed in a quarry operation <br /> 1.3. Operator shall not utilize offender labor crews off Quarry premises;all offenders must remain <br /> on the Quarry premises. <br /> 1.4. Operator shall provide sanitary facilities for offender work crews'use at the Quarry,including <br /> potable fresh water for sanitary purposes and drinking. <br /> 1.5. Operator shah provide and have available on site where used all necessary Material Safety Data <br /> Sheets(MSDS)for all pesticides,chemicals,and substances used in the quarry operation. <br /> Operator shall notify the CCi Crew Leader of any pesticides,chemicals,and substances used <br /> within the arm where offenders will be working. <br /> 1.6. Operator shall provide all took,equipmett,and protective and safety equipment(erg.eye,car, <br /> mask,and head protection)required for safe work. <br /> 1.7. Operator shall provide notice at least forty-eight(48)hours in advance to the CCi Crew Leader <br /> Of <br /> 1.7.1. the type of work needed, <br /> 1.7.2. the protective clothing required for the work(e g.long sleeved shirts,long pants,steel <br /> too protective footwear,gloves),and <br /> 1.7.3. the approximate number of offenders requested. <br /> I.B. Operator may require that any individual offender not return to the Quarry. <br /> 1.9. Operator shall request orientation for any newly hired employees,in accordance with section <br /> 2.6 below,at a location deemed mutually agreeable to the Parties. <br /> 1.10.Operator shall sign a delivery record at the end of each day verifying the hours worked by the <br /> CCi offender crew that day. <br /> 1.11.Operator shall maintain a complete file of all work records and communications for the term of <br /> this Agreement,plus an additional three(3)years after the termination of this Agreement or for <br /> such further period as may be necessary to resolve any matters which may be pending. <br /> 1.12.Operator will not displace any workers and no jobs will be taken away from the community as a <br /> result of the use of offender labor. <br /> 2. CCi's Obli t¢a ions: <br /> 2.1. Furnish labor crews of offender workers of no more than ten(10)offender workers,per CCi <br /> supervisor,Monday through Friday,up to forty(40)hours per week per offender labor crew, <br /> excluding state of Colorado government holidays. <br /> Page 2of10 <br /> Exhibit H-2 <br /> N �aa <br />
