I, Jared Ebert and Dan Hernandez of the Colorado Division of Reclamation, Mining and Safety conducted <br />the inspection. Mr. Brian Watterson with Moffat County Mining, LLC (MCM) accompanied us during the <br />inspection. The weather was partly cloudy to mostly sunny during the inspection. <br />EXCESS SPOIL and DEVELOPMENT WASTE — Rule 4.09 <br />Placement; Drainage Control; Surface Stabilization: <br />The waste disposal site appeared stable and vegetated. Small bare areas exist near the southern end of the disposal <br />area. <br />The No. 9 refuse pile was vegetated and stable. <br />The solid waste disposal area appears to have not been used in some time, however no problems were observed. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Diversion ditch 5 -D2 had been previously obstructed by a berm placed in the middle of the diversion at the south <br />west end of the ditch. MCM has removed the berm and re- established drainage in the diversion ditch. <br />Culvert 2 appears to have been cleaned out. <br />Culvert 6 appears to be about 1/2 full of sediment and will need to be monitored and cleaned out in the future. <br />Number of Partial Inspection this Fiscal Year: 0 <br />Number of Complete Inspections this Fiscal Year: 1 <br />Page 2 of 6 <br />
