SPECIAL USE PERMIT 2014 -05 <br />Prowers County Special Use Standards Attachment <br />The following property and "use" described in this document, outlines the development standards that are to be <br />followed as a condition of Prowers County granting a Special Use Permit. The Requirements are those the <br />PIanning Commission have found are needed to comply with the County's Zoning regulations for the permitted <br />"use" to be in compliance. This document is a supplementary document to the permit granted and is for purposes of <br />describing permit requirements. <br />Permit Information <br />Permit is applicable for the following site and "use ". <br />Sand and Gravel Mining Operation — Amendment of SUP Issued November 9, 2010; <br />Amended to include 19 acres to accommodate a 112 mining permit <br />Property Information <br />Address of Property: 1251 CR LL, Wiley, Co 81092 <br />Land Owner -Name: Hans Friederichs Jr. and JoLeyne White Heckman Friederichs <br />Applicable Requirements of the Special/Conditional -Use Permit <br />These items are standards and conditions that must be complied with for the "use" permitted to be in compliance <br />with the permit granted. <br />1. Personnel from the Prowers County Land Use Office shall be granted access on to the property at any <br />reasonable time in order to ensure the activities carried out on the property comply with the <br />development standards stated hereon and all applicable Prowers County regulations. Annual reviews <br />will be conducted by the Prowers County Land Use Office at the developer /operator's expense until <br />such time as the project is completed with final reclamation per state mining board. <br />2. The Special Use Permit shall be limited to the plans shown hereon and governed by the foregoing <br />standards and all applicable Prowers County regulations. Substantial changes from the plans or <br />development standards as shown or stated shall require the approval of an amendment of the Permit by <br />the Prowers County Planning Commission before such changes from the plans or development <br />standards are permitted. <br />3. All appropriate permits for federal and state agencies shall be obtained and adhered to, with copies of <br />said permits forwarded to the Prowers County Land Use Office. <br />4. No permanent disposal of wastes shall be permitted at this site. <br />5. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30 -20 -100 <br />C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against <br />surface and groundwater contamination. <br />6. Waste materials shall be handled, stored and disposed of in a manner that controls fugitive dust, <br />blowing debris, and other potential nuisance conditions. <br />7. All Fugitive dust, either from construction or transportation of equipment, shall be controlled on the <br />site. <br />8. The developer /operator shall be responsible for complying with all of the foregoing development <br />standards. Noncompliance with any of the foregoing development standards may be reason for <br />revocation of the permit by the Planning Commission and/or Board of County Commissioners. <br />Special Use Permit 2014 -05 Friederichs Gravel Pit Page 2 of 2 <br />
