SPECIAL USE PERMIT 2014 -05 Prowers County Special Use Standards Attachment The following property and "use" described in this document, outlines the development standards that are to be followed as a condition of Prowers County granting a Special Use Permit. The Requirements are those the PIanning Commission have found are needed to comply with the County's Zoning regulations for the permitted "use" to be in compliance. This document is a supplementary document to the permit granted and is for purposes of describing permit requirements. Permit Information Permit is applicable for the following site and "use ". Sand and Gravel Mining Operation — Amendment of SUP Issued November 9, 2010; Amended to include 19 acres to accommodate a 112 mining permit Property Information Address of Property: 1251 CR LL, Wiley, Co 81092 Land Owner -Name: Hans Friederichs Jr. and JoLeyne White Heckman Friederichs Applicable Requirements of the Special/Conditional -Use Permit These items are standards and conditions that must be complied with for the "use" permitted to be in compliance with the permit granted. 1. Personnel from the Prowers County Land Use Office shall be granted access on to the property at any reasonable time in order to ensure the activities carried out on the property comply with the development standards stated hereon and all applicable Prowers County regulations. Annual reviews will be conducted by the Prowers County Land Use Office at the developer /operator's expense until such time as the project is completed with final reclamation per state mining board. 2. The Special Use Permit shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Prowers County regulations. Substantial changes from the plans or development standards as shown or stated shall require the approval of an amendment of the Permit by the Prowers County Planning Commission before such changes from the plans or development standards are permitted. 3. All appropriate permits for federal and state agencies shall be obtained and adhered to, with copies of said permits forwarded to the Prowers County Land Use Office. 4. No permanent disposal of wastes shall be permitted at this site. 5. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30 -20 -100 C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. Waste materials shall be handled, stored and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. All Fugitive dust, either from construction or transportation of equipment, shall be controlled on the site. 8. The developer /operator shall be responsible for complying with all of the foregoing development standards. Noncompliance with any of the foregoing development standards may be reason for revocation of the permit by the Planning Commission and/or Board of County Commissioners.
