Early in July 2013, the preliminary EA was made available for public comment, particularly to <br />parties that commented during scoping. A total of approximately 15 comments were obtained <br />during the entire period until the EA was finalized in late September 2013. Those comments <br />were reviewed and considered in the development of the final EA. There were no substantive <br />comments that :necessitated the BLM to revisit the Proposed Action through additional NEPA <br />proceedings. <br />The USFS issued a consent decision on October 2, 2013, and it was appealed on the last day of <br />their appeal period (November 18, 2413) by Terror Ditch and Reservoir Company (TDRC). On <br />November 26, 2013, the USFS notified the appellant and the BLM that the appellant did not <br />submit substantive comments during their comment period and dismissed the appeal <br />accordingly. The appeal dismissal was contested and USFS renewed their dismissal decision on <br />January 10, 2014. The USFS sent their consent letter to BLM on January 29, 2414. <br />A Finding of No Significant Impact (FONSI) was prepared, based on the information contained <br />in the EA and my consideration of criteria for significance (40 CFR 1508.27). It is my <br />determination that: 1) the implementation of the Proposed Action will not have significant <br />environmental impacts; 2) the Proposed Action is in conformance with the Uncompahgre Basin <br />Resource Management Plan; and 3) the Proposed Action does not constitute a major federal <br />action having significant effect on the human environment. Therefore, an Environmental Impact <br />Statement is not necessary. <br />2-111011T "1MI <br />The BLM decision to offer the coal LBA is subject to appeal to the Interior Board of Land <br />Appeals (IBLA). Anyone wishing to appeal will have 30 days from this decision to appeal to the <br />Board of Land Appeals, Office of the Secretary, in accordance with regulations at 43 CFR Part 4. <br />Appeal and stay procedures are outlined in Form 1842 -1. <br />ENVIRONMENTAL COORDINATOR:..
