will be borne by the lessee or operator, and all data and materials salvaged will remain under <br />the jurisdiction of the U.S. Government as appropriate. <br />The lessee or operator shall immediately bring to the attention of the FS and BLM any cultural <br />or paleontological resources or any other objects of scientific interest discovered as a result of <br />surface operations under this lease, and shall leave such discoveries intact until directed to <br />proceed by FS and BLM. <br />ENDANGERED OR THREATENED SPECIES - The USES is responsible for assuring that the <br />leased land is examined prior to undertaking any surface - disturbing activities to determine <br />effects upon any plant or animal species listed or proposed for listing as endangered or <br />threatened, or their habitats. The findings of this examination may result in some restrictions to <br />the operator's plans or even disallow use and occupancy that would be in violation of the <br />Endangered Species Act of 1973 by detrimentally affecting endangered or threatened species or <br />their habitats. <br />The lessee /operator may, unless notified by the USFS that the examination is not necessary, <br />conduct the examination on the leased lands at his discretion and cost. This examination must <br />be done by or under the supervision of a qualified resource specialist approved by the USFS. <br />An acceptable report must be provided to the USFS identifying the anticipated effects of a <br />proposed action on endangered or threatened species or their habitats. <br />MONITORING: <br />Normal routine compliance inspections will take place periodically throughout the life of the <br />lease. The inspections will be designed to monitor environmental effects of the Proposed Action <br />and to insure that the operator complies with the lease stipulations. In addition, all surface <br />disturbing and mining activities on the lease will be monitored by the Colorado Division of <br />Mining, Reclamation, & Safety, the USFS, and BLM during the mine and reclamation plan <br />permitting process. <br />COMPLIANCE WITH MAJOR LAWS: <br />The decision is in compliance with applicable laws, regulations and policy, including the <br />Endangered Species Act, Migratory Bird Treaty Act, Clean Water Act, Clean Air Act, and the <br />National Historic Preservation Act. <br />PUBLIC INVOLVEMENT: <br />Public continents were solicited via a letter, dated January 16, 2013, that was mailed to more <br />than 700 interested parties including the appropriate agencies, specific interested parties, and to <br />the general public. The scoping notice was also published in the Delta County Independent and <br />the Grand Junction Daily Sentinel and posted on both the BLM UFO and the USFS websites. <br />Public continents were received through February 22, 2013. A total of 20 comment letters were <br />received during the public comment period. All comment letters were reviewed and considered <br />in the development of the preliminary EA. <br />11 <br />
