Amended 25th Ave SWSP <br />September 2, 2014 <br />Page 2 of 4 <br />the first year of this plan period, and 14.72 acre -feet during the second year of this plan period. <br />Lagged operational depletions, resulting from both past and projected operations at the site, <br />are estimated to total 9.02 acre -feet during the first year of this plan period, and 13.50 acre -feet <br />during the second year of this plan period. <br />Dewateri ng <br />You have revised the average monthly dewatering rate to 297 gallons per minute for June <br />2014, based on actual metered pumping. (Please note that the maximum dewatering rate of 5,521 <br />gallons per minute is an instantaneous rate during peak pumping periods for all three pumps <br />combined.) <br />Lagged depletions associated with the dewatering of Flatiron Pits 3 and 4 are estimated to <br />total 388.39 acre -feet during the first year of this plan period, and 331.58 acre -feet during the <br />second year of this plan period, which are partially offset with a credit for dewatering water <br />discharged to the river of 307.96 acre -feet for the first year and 291.13 acre -feet for the second year. <br />Actual monthly meter readings must be used to determine the actual dewatering rate and the <br />resulting depletions under this SWSP. <br />Replacements <br />A monthly breakdown of depletions and replacements for Flatiron Pits 3 and 4 is shown in the <br />attached Table 1A (amended 7/15/14 and updated 09/2/14). There is no change to the depletions <br />and replacements for Flatiron Pit 5. <br />Conditions of Approval <br />I hereby approve the amended substitute water supply plan in accordance with 5 37 -90- 137(11), <br />C. R.S., subject to the following conditions. All terms and conditions of the original SWSP approval dated <br />July 8, 2014 remain in full force and effect except as amended herein. For convenience and clarity, the <br />full list of terms and conditions governing this SWSP, as amended, are provided below. <br />1. This SWSP shall be valid for the period of June 1, 2014 through May 31, 2016, unless otherwise <br />revoked, modified, or superseded by decree. If this plan will not be made absolute by a water court <br />action by the plan's expiration date, a renewal request must be submitted to this office with the <br />statutory fee (currently $257) no later than April 1, 2016. <br />2. The proposed uses exceed those uses currently allowed under well permit no. 76246 -F, therefore a <br />new well permit must be obtained for the current use and exposed surface area of the gravel pit <br />in accordance with 537 -90- 137(2) and (11), C.R.S. in conjunction with this plan. An application for <br />a new well permit is currently pending under receipt no. 3666036 and will be evaluated <br />subsequent to approval of this SWSP. The provisions of Colorado Revised Statute 37 -90- 137(2) <br />prohibits the issuance of a permit for a well to be located within 600 feet of any existing well, <br />unless the State Engineer finds that circumstances so warrant after a hearing held in accordance <br />with the procedural rules in 2CCR402 -5. This hearing may be waived if you are able to obtain <br />statements from the owners of all wells within 600 feet, verifying that they have no objection to <br />your use of the proposed well. Should a new well permit be denied for reasons of 600 foot <br />spacing, or any other legitimate reason, approval of this substitute supply plan may be cancelled. <br />3. The total surface area of the groundwater exposed at the 25th Ave Site after December 31, 1980 <br />
