M- 2014 -041 - Mr. Russell Painter <br />September 11, 2014 <br />Page 2 <br />6.3.7 EXHIBIT G - Source of Legal Right to Enter <br />3. This Rule, requires the Division be provided a description of the basis for legal right of entry to <br />the site and to conduct mining and reclamation. For mining operations on USFS land, this is <br />typically in the form of an approved Plan of Operations (POO). The Poo provided in the <br />Application is still being reviewed by the USFS, and is missing the approval signature on page 8. <br />In lieu of a signed/approved PoO, the Division will need a signed statement by the Landowner(s) <br />and acknowledged by a Notary Public stating that the Operator /Applicant has legal right to enter. <br />Please provide a notarized letter from the USFS confirming your legal right to enter and to <br />conduct mining and reclamation. <br />Please be advised the Macanite #VII & #VIII Application may be deemed inadequate and the application <br />may be denied on September 15, 2014 unless the abovementioned adequacy review items are addressed to <br />the satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can <br />grant an extension to the decision date. This will be done upon receipt of a written waiver of your right to a <br />decision by September 15, 2014 and request for additional time.
