treating with herbicides as described above for the current situation. Upon completion of final <br />reclamation activities, the approved weed control plan for post -final reclamation and <br />maintenance of the revegetated areas will take effect. <br />Please see attached modified Technical Revision 1 Map "Exhibit C -2 Mining Plan Map AM -4" (at <br />a reduced scale) showing areas of proposed current weed control. Locations and extent are <br />approximate and will be field verified during the application procedures. <br />CORRECTIVE ACTION 2: A revised groundwater mitigation plan to relieve upgradient mounding of <br />alluvial groundwater affecting offsite structures by flooding is required to be developed by the permit <br />holder. The DRMS has set out specific required responses based upon the site visits of August 4th and <br />August 14th to detail the construction and operation of the new East Boundary Trench. Those responses <br />are given below. <br />RESPONSES TO EAST BOUNDARY TRENCH CONSTRUCTION AND OPERATION: <br />1. Both a plan and cross - section view is provided of the new East Boundary Trench. The <br />plan view is drawn onto a full -scale portion of the east side of Exhibit C -2 (from DRMS <br />Amendment No. 4) and shows the full length of the trench at an approximately correct <br />scale from the head of the trench to the outlet in the lake that now fills the mined -out <br />pit. Access to the entire length of the trench is currently limited, but the elevation at <br />the head of the trench is 5011.85 ft. MSL with a positive drainage gradient of probably <br />around 1 %. The exact location of this elevation is in the bottom of the trench at the <br />extreme southern end and is on ground that is yet a little high and will be lowered by <br />6 -8 inches upon final clean -out. This coincides extremely well with the 2009 French <br />Drain design requiring the head of the trench where the pipe bedding is to be placed <br />(-250 ft. to the south from the current head of the trench) to be at an elevation of <br />5012 ft. and the terminus of the Phase 1 section (at the lake edge) to be at 5010 ft. <br />When the trench is finalized and the excavated material is removed, a few more <br />elevation data points along the length of the trench will be obtained as well as at the <br />terminus. The cross - section view is drawn as a representative section of the entire <br />length of the East Boundary Trench and measurements are shown of each element of <br />the trench construction. <br />2. All 200 ft. structure agreements have been in place for structures (utilities and the <br />road) along Brighton Rd. since 2000, 2001 and 2004. These should be found in the <br />DRMS file for this operation. I am including copies of agreements from United Power, <br />South Adams County Water and Sanitation District and indirectly, Adams County for <br />Brighton Rd. Considering that Adams County (Engineering and Public Works) gave the <br />approval for mining within 50 ft. of the edge of pavement of Brighton Rd., this <br />constitutes a "structure agreement ". Increased R.O.W. was also given to Adams <br />County as part of the approval for mining on the property that constituted the 3`d <br />DRMS amendment.
